Terms and Conditions of Sale
Article 1 - Purpose
These Terms and Conditions of Sale govern the contractual relationship between Mediatartiflette, hereinafter referred to as "the Provider", and any natural or legal person wishing to use the services offered on the website mediatartiflette.com, hereinafter referred to as "the Client". Any use of the paid services on the site implies unreserved acceptance of these Terms of Sale.
Article 2 - Services offered
The Provider offers a TikTok profile analysis service that generates a virality score out of 20 points, based on 7 evaluation criteria. The service includes analysis of the Client's public TikTok profile data, calculation of a detailed score, generation of personalized advice and creation of a shareable score card. Free and paid services are described in detail on the website.
Article 3 - Pricing and payment
Service prices are displayed in euros, including all applicable taxes, on the website. The Provider reserves the right to modify prices at any time, with services being billed at the rate in effect at the time of order. Payment is made online by credit card or any other payment method available on the site. Payment is due immediately upon order.
Article 4 - Right of withdrawal
In accordance with applicable consumer protection laws, the Client acknowledges that the right of withdrawal cannot be exercised for contracts for the supply of digital content provided on an intangible medium whose execution has begun with the prior express consent of the Client. By accepting these Terms of Sale, the Client expressly waives the right of withdrawal once the profile analysis has been initiated.
Article 5 - Liability
The Provider undertakes to deliver its services with diligence and in accordance with industry best practices. Analysis results are provided for informational purposes only and do not constitute a guarantee of performance on TikTok. The Provider shall not be held liable for decisions made by the Client based on the analysis results. The Provider's liability is limited to the amount of the service ordered.
Article 6 - Personal data
The processing of personal data is described in our Privacy Policy. The Provider commits to complying with applicable data protection regulations, including the General Data Protection Regulation (GDPR) of April 27, 2016. Data collected is necessary for the provision of services and is never resold to third parties.
Article 7 - Applicable law and disputes
These Terms of Sale are governed by French law. In the event of a dispute, the parties agree to seek an amicable solution before taking any legal action. Failing amicable resolution within 30 days, the dispute shall be submitted to the competent courts. In accordance with consumer protection laws, the Client may also resort to a consumer mediator.
